Freedom of speech and punishment - when society loses its measure

Sloboda govora i kazna – simbol društva u kojem se gubi mjera između izražavanja mišljenja i represije

Freedom of speech and punishment are one of the most sensitive issues of modern society, especially when the balance between responsibility and justice is lost.

The case of Face (Amir Pašić) reopened an important question that periodically returns to the public space: where is the line between freedom of speech and responsibility for the spoken word? I do not support swearing, insults or vulgarity in public communication. However, imprisonment for words - without violence - requires a sober, calm and reasonable analysis.

This one apa analysis does not defend inappropriate speech, but insists on measure. Because without measure there is no justice, no freedom, no trust in institutions.

Who is Faco and why is this case important?

Faco is a public figure who has been vocal in his criticism of authorities, institutions and social deviations for years. His communication style is often rude, inappropriate and not at all exemplary. This is a fact and should not be relativized.

However, another fact is that he spoke about topics that affect a large part of society: corruption, irresponsibility, collapsed institutions and a sense of injustice. The question, therefore, is not whether the style is good (it is not), but whether it is prison reasonable and proportionate response to speech.

Speech without measure - but also punishment without measure

Public speaking carries responsibility. Anyone who speaks to the public must know that words have weight and consequences. However, punishment must have purpose: warning, correction and protection of society.

When punishment becomes a demonstration of force rather than a correction of behavior, it loses its moral meaning. ApA roadmap in this case it is clear: the punishment should be repaired, not broken.

A time for reflection, not for crushing

It's been a month and a half since Faco was arrested. I sincerely hope he's using this time for personal development – reading books, studying, thinking, and even spiritual growth.

Time in prison should not serve to break a person, but to warn. If one wants to engage in public business or politics, one must learn that a message can be conveyed forcefully, clearly and with dignity, without profanity.

Vocabulary is not spread on social networks, but through learning, experience and self-control.

Punishment should be a warning, not revenge Amir Pasic Faco

I do not believe that prison should be the answer to speech, especially when there is no violence. Faco is not a bully or someone who threatens people's safety. He is a loud Sarajevo, a child of the city, with a street mentality - often rude, but also honest.

If "the cart broke down," it broke down on him. And that is already a clear message to everyone else.

Therefore, I believe it would be reasonable for the sentence to remain a warning, rather than a long-term deprivation of liberty.

Proposal for Amir Pasic Faco: a human and symbolic gesture

I believe it would be humane and reasonable to consider the possibility of allowing Faci to spend the New Year free in Sarajevo. Not as a reward, but as a sign that the system knows how to distinguish speech from violence and that there is room for correction, not just punishment.

Sarajevo has always had its loud, witty, sometimes rude characters. It is part of the spirit of the city. But Sarajevo always knew how to give a second chance.

Amir Pasic Faco Philosophical perspective: truth, speech and measure

If one looks at this case from a distance, through the prism of classical philosophy, it becomes clear that the issue is not in any one person, but in society's attitude towards speech and punishment.

Socrates also showed that societies often do not punish violence, but unpleasant questions and words that expose the weaknesses of the system. His case remains a lasting reminder that the punishment of speech often speaks more to the fear of the order than to the actual guilt of the individual.

On the other hand, Aristotle reminds us of what is often missing today - measure. Speech without measure loses dignity, but punishment without measure also loses justice. Between these two extremes lies the space of reason, in which society should react proportionately and responsibly.

From this perspective, the Face case requires neither idealization nor demonization, but a sober assessment: how to respond to inappropriate speech without losing sight of the basic principle – that punishment should repair, not break.

Freedom of speech and punishment must be balanced if society is to maintain confidence in justice.

Message from Amir Pasic Faco

If you ever read these words –
use this time to build yourself up.

If you want to change society, do it with words that touch the essence, not offend.
The truth can be told without cursing.

The message is stronger when the language is pure.

Conclusion: Between question, measure and responsibility

Throughout history, societies have faced the same challenge again and again: how to respond to speech that is unpleasant, harsh, or inappropriate without losing a sense of justice.

Socrates reminds us that societies often punish questions before they face the answers. Aristotle teaches us that without measure there is no just punishment. Contemporary cases, like this one, are not a verdict on an individual, but a test of society.

Test whether we know how to distinguish speech from violence, warning from revenge and justice from fear.

Without questions, there is no truth.
Without measure there is no justice.
There is no freedom without responsibility.

3 ApA Questions?

1️⃣ Does society today punish speech because it is inappropriate or because it is unpleasant for order?

2️⃣ Where is the line between responsibility for the spoken word and punishment that ceases to be just?

3️⃣ Can a society without measures simultaneously preserve both freedom of speech and trust in justice?
